This is not the time for sheep.
You may have heard that the Board of Trustees filed a Motion for a Summary Judgment (MSJ) in the Virginia Elizondo vs. SBISD Board of Trustees lawsuit. A MSJ is a request by a party that the Judge dismiss the lawsuit before trial. This is a common motion filed in lawsuits.
You may have also heard that my opponent’s current Facebook post claims that this MSJ is evidence that he has been fighting the lawsuit since it was filed. His words now may suggest this, but his ACTIONS have never shown this. Those actions are:
—my opponent endorsed Virginia Elizondo, who lost to Chris Earnest last year. She then turned around and sued the Board that endorsed her.
—my opponent and his lawyers worked with Elizondo and her lawyers to negotiate a settlement in the Fall of 2021. My opponent was so certain about the settlement that he spoke to a parent in the district about his decision to settle the lawsuit because we “might as well”.
—my opponent and his lawyers objected to Jenny Morace’s Motion to Intervene in the lawsuit.
—my opponent and his lawyers agreed with Elizondo and her lawyers to delay our elections to November, but were thwarted when a federal judge denied their agreed motion.
But now, he wants you to believe that he will always fight for our At-Large system. Too little too late - his actions show he “might as well” take the path of least resistance.
My words and actions on this topic have never wavered, I have never faltered, and I will never back down for what is right as your SBISD Trustee.
